The new Italian labour reforms are reducing the statutory protections for employees – while at the same time increasing their contractual protections. Both businesses and the professionals that manage their human resources should be aware of their responsibilities and in particular the ones that, if not managed correctly, could take them to the criminal courts.
During this event LEXELLENT will confront important Italian employment and labour law cases that have led to employers being sanctioned – for example , by being in violation of the Italian Workers’ Statute.
Instead of focusing on the most obvious crime – that of hiring workers illegally ( also often referred to as ‘under the table’) – this presentation will explore the responsibility of Italian employers not only in terms of health and safety in the workplace but also in terms of errors of judgment which companies and their management may make. For example – extortion in the working relationship, unlawful interference in the private life of employees, and defamation through the indiscriminate use of social networks.
With the ongoing Italian Labour Reforms it is likely that violations that carry a sanction today – may in the future also implicate Italian penal law. For this reason it is important for employers in Italy to open their eyes and to understand what types of conduct, in terms of the workforce, might lead to grave consequences.
